Terms of Service

These Terms of Service ("Terms") govern your access to and use of Comic Gen Studio (the "Service"), a web-based AI-powered comic creation platform. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that you have the legal capacity to enter into a binding agreement.

If you are using the Service on behalf of a company or other organization, you represent that you are authorized to bind that organization to these Terms, and "you" refers to that organization.

2. Accounts

You need an account to use most features of the Service. You agree to provide accurate information when registering and to keep your account information current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Notify us promptly if you suspect any unauthorized use of your account. We are not liable for losses caused by unauthorized use that you fail to report.

3. Your Content

"User Content" means any text, story, prompts, reference images, characters, scripts, comments, settings, and other materials you upload, create, or submit to the Service.

Ownership. You retain all rights you have in your User Content. We do not claim ownership of it.

License to us. You grant Comic Gen Studio a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (e.g. resize, transcode), transmit, and display your User Content solely as needed to provide and improve the Service for you, including running it through third-party AI providers we use to fulfill your requests.

Your responsibility. You represent and warrant that you have all rights necessary to upload your User Content and to grant us the license above, and that your User Content does not infringe any third party's intellectual property, privacy, or other rights, and does not violate any law.

4. AI-Generated Output

The Service uses third-party AI models (such as those from OpenAI and Google) to generate text, character designs, comic panels, page images, and other "Output" in response to your prompts and User Content.

Ownership of Output. Subject to your compliance with these Terms, as between you and us, we assign to you all of our right, title, and interest (if any) in Output that the Service generates from your prompts. You may use Output for your own purposes, including commercial purposes, subject to applicable law and the terms of any third-party AI provider whose model produced the Output.

Similarity. Because AI models are probabilistic and many users may submit similar prompts, Output may not be unique to you. Other users may receive similar or identical Output in response to similar prompts. We do not represent that Output is unique.

Accuracy. Output is generated by machine learning models and may be inaccurate, incomplete, biased, or otherwise unsuitable. You are responsible for evaluating Output before relying on it, especially before publication or commercial use, and for ensuring that any final work product you publish complies with applicable law and does not infringe any third party's rights.

5. Acceptable Use

You agree NOT to use the Service to:

  • Generate content that is illegal, defamatory, harassing, threatening, or that infringes any third party's rights.
  • Generate sexual content involving minors, or any content that sexually exploits or endangers minors in any way.
  • Generate content intended to facilitate self-harm, terrorism, mass violence, or other serious physical harm.
  • Generate content that impersonates real persons in a misleading manner, including non-consensual likenesses, "deepfakes" of identifiable individuals, or content presenting fabricated statements as if real.
  • Reverse engineer, decompile, scrape, or attempt to derive the source code, models, or training data underlying the Service or any component of it.
  • Use the Service to develop or train competing AI models.
  • Circumvent rate limits, usage caps, billing controls, or any technical measures designed to protect the Service.
  • Resell, sublicense, or commercially redistribute access to the Service itself (as opposed to your Output).
  • Upload malware, viruses, or any code intended to disrupt or damage the Service or other users.
  • Use the Service in any way that violates applicable export controls, sanctions, or other laws.

We may suspend or terminate accounts that violate these rules without prior notice.

6. Third-Party Services

The Service integrates with third-party services, including AI model providers and payment processors. Your use of those third-party services is governed by their own terms and privacy policies, and we are not responsible for their acts or omissions. Outages, errors, or changes to a third-party service may affect the availability or behavior of the Service.

7. Plans, Billing, and Usage

Some features of the Service are offered on a paid subscription or pay-as-you-go basis. By selecting a paid plan, you agree to pay all applicable fees, taxes, and charges. Fees are billed in advance and are non-refundable except where required by law.

The Service may meter usage in tokens, credits, generations, or similar units. Overage rules, included quotas, and the price per unit are described on the pricing page or at checkout. We may change prices and plan features prospectively; changes will not apply to a billing period you have already paid for.

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access until then.

8. Our Intellectual Property

The Service, including its software, design, branding, and documentation (but excluding User Content and Output), is owned by Comic Gen Studio and its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for the purposes described in these Terms. We reserve all rights not expressly granted.

9. Feedback

If you send us suggestions, ideas, or feedback about the Service, we may use them for any purpose without compensation or attribution. You grant us a perpetual, irrevocable, royalty-free license to use any such feedback.

10. Suspension and Termination

You may stop using the Service at any time and may close your account from your settings. We may suspend or terminate your access to the Service immediately if we believe you have violated these Terms, if required by law, or if continued provision of the Service to you creates a risk to us or to other users. We may also discontinue the Service in whole or in part with reasonable notice.

Upon termination, your right to access the Service ends. We may delete your User Content and Output after a reasonable period; we recommend exporting anything you want to keep before closing your account.

11. Disclaimer of Warranties

The Service and all Output are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, we disclaim all such warranties.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Comic Gen Studio, its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid to us for the Service in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

13. Indemnity

You agree to defend, indemnify, and hold harmless Comic Gen Studio and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your User Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your use, distribution, or publication of Output.

14. Changes to the Service or These Terms

We may modify or discontinue features of the Service at any time. We may also change these Terms by posting a revised version with an updated "Last updated" date. Material changes will be communicated to you (for example, by email or an in-app notice) before they take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Comic Gen Studio is organized, without regard to its conflict-of-law principles. You and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any right you may have under mandatory consumer-protection laws of your country of residence.

16. Miscellaneous

These Terms (together with our Privacy Policy and any plan-specific terms you accept at checkout) constitute the entire agreement between you and us regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
